Article 1 – Definitions
In these General Terms and Conditions, the following definitions apply:
Cooling-Off Period: The 30-day period during which the consumer may exercise their right of withdrawal;
Consumer: A natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur;
Long-Term Transaction: A distance contract relating to a series of products or services for which the delivery obligation is spread over a period of time;
Right of Withdrawal: The consumer's right to withdraw from the distance contract within the cooling-off period;
Entrepreneur: Alga, the natural or legal person offering products to consumers at a distance;
Distance Contract: An agreement concluded between Alga and the consumer through means of distance communication;
CESOP: The Central Electronic System of Payment Information, introduced by the European Union for the monitoring of payment service providers.

Article 3 – Applicability
These General Terms and Conditions apply to every offer made by Alga and to every distance contract concluded between Alga and the consumer. Before the agreement is concluded, these terms and conditions will be made available to the consumer electronically or by other means.
Article 4 – The Offer
All offers made by Alga are non-binding. Alga reserves the right to modify or withdraw offers.
The offer clearly states the total costs, including shipping costs, import duties, and any additional charges imposed by postal or courier services.
Article 5 – The Agreement
The agreement is concluded once the consumer accepts Alga offer and complies with the stated conditions. Alga will confirm acceptance by email.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the agreement without providing a reason within 30 days of receiving the product.
The costs of returning the product are the responsibility of the consumer.
Article 7 – Costs in the Event of Withdrawal
Alga will refund the amounts paid by the consumer within 30 days of receiving the withdrawal request, provided that the returned product has been received in its original condition and packaging.
Article 8 – Customs, Import Duties, and VAT Obligations
8.1 All products are shipped under the Delivered Duty Unpaid (DDU) delivery condition. This means that the consumer is fully responsible for all import costs and obligations upon the products entering the destination country.
8.2 These obligations include, but are not limited to:

Payment of import duties, VAT, or other taxes;

Customs clearance costs, such as brokerage and administrative fees charged by couriers or customs authorities;

Compliance with local laws and product regulations in the country of delivery.
8.3 Alga does not act as the formal importer of the ordered products. Ownership and responsibility are transferred to the consumer upon shipment. Alga is not liable for delays, seizures, or costs resulting from the consumer's failure to comply with applicable requirements.
8.4 Alga provides the required shipping documentation, such as an invoice, product description, and declared value, but does not guarantee that these documents meet the specific requirements of the destination country.
8.5 The consumer indemnifies Alga against all financial consequences, claims, or penalties resulting from failure to comply with import regulations.
8.6 Consumers are strongly advised to contact their local customs authorities before placing an order to avoid unexpected charges or issues at the border.
Article 9 – CESOP Compliance
As of 2024, payment service providers register transaction data in the European CESOP system. Alga complies with this regulation, which may affect the monitoring and reporting of payments.
Article 10 – Conformity and Warranty
Alga guarantees that the products comply with the agreement and applicable legal requirements.
Complaints regarding defects must be submitted in writing no later than 14 days after receipt.
Returns must be made in their original condition and packaging.
Article 11 – Delivery
Orders will be delivered within 30 days unless otherwise agreed.
In the event of a delay, the consumer will be informed no later than 14 days after placing the order.
The consumer is responsible for handling import procedures.
Alga operates in accordance with international shipping standards but is not liable for delays caused by customs.
Failure by the consumer to comply with import obligations does not entitle the consumer to cancellation or a refund.
Article 12 – Complaints Procedure
Complaints must be submitted in writing within 7 days of discovering the issue.
Alga will respond within 14 days. If a complaint requires more time to process, an estimated timeframe for resolution will be provided.
Article 13 – Disputes
These terms and conditions are governed by Dutch law. Disputes will preferably be resolved through mutual consultation. If necessary, disputes will be submitted to the competent court in the Netherlands.
